4 Yol Gösterici İlkede Çocuk Hakları Sözleşmesi

Birleşmiş Milletler Genel Kurulu tarafından 20 Kasım 1989 tarihinde imzalanan Çocuk Hakları Sözleşmesi 2 Eylül 1990 tarihinde yürürlüğe girdi. Türkiye de dâhil olmak üzere 196 ülkenin taraf olduğu sözleşme dünyada en fazla ülkenin onayladığı insan hakları belgesi olma özelliğini taşıyor.

Çocukların yaşaması ve gelişmesi, ayrımcılığa uğramaması, çocuğun yüksek yararının gözetilmesi ve çocuk katılımını temel alan belge çocuk hakları alanında bir rehber niteliği taşıyor.

Sözleşme’nin dört adet yol gösterici ilkesi bulunuyor ve bu ilkeler hakların tümünün yerine getirilmesi için temel gerekliliklerdir.

1.Ayrımcılık Yapmama

Sözleşmenin 42. maddesi dinleri, ırkları veya yetenekleri ne olursa olsun; ne düşündükleri veya söyledikleri gözetilmeksizin; kültürleri ne olursa olsun; kız veya erkek, zengin veya fakir fark etmeksizin tüm çocukların eşitliğini bildirir.

2.Çocuğun Üstün Yararı

Çocukları etkileyebilecek yönde verilen her karar veya yapılan her işlem her zaman için onların üstün yararına öncelik tanımalıdır.

3.Çocuğun Varlığını ve Gelişimini Sürdürmesini Sağlama

Her çocuğun yaşama hakkı vardır. Onlara gelişmeleri ve potansiyellerini gerçekleştirebilmeleri için her fırsatın temin edilmesi, karar verme yetkisine sahip bireylerin sorumluluğundadır.

4.Katılım

Çocuklar kendi yaşam ve tecrübelerinin uzmanlarıdır ve kendilerini etkileyecek kararlarda onlara danışılması gerekmektedir. Her çocuğun kendi düşüncesini ifade etme hakkı vardır.
Bizler de projemiz kapsamında yürüttüğümüz çalışmalarımızda çocuğun yüksek yararını göz önüne alarak ilgili kurumların kurumsal kapasitelerini geliştirmelerine katkı sağlıyoruz.

We Held The Third of The “Step by Step Advocacy Workshop” Events in Ankara!

As Özne Çocuk, we came together with civil society organizations in Ankara on 13-14 April 2023 to hold the third of the “Step by Step Advocacy Workshop”.

During the two-day workshop, we worked on child rights and advocacy together with civil society organizations active in different areas of child rights such as child protection, child participation, child labour, early marriage, migration and child poverty. Local governmental bodies working in the field of child rights have also participated in our event.

What did we do at the workshop?

During the workshops, both successful and unsuccessful examples of advocacy work were discussed and participants exchanged ideas and inspired one another.

We Gathered with Children in Bursa to Talk About Advocacy!

As Özne Çocuk, we met with children to talk about "children's rights and advocacy" on January 26, 2023.

In this event held with the children who are members of the Provincial Child Rights Committee from various provinces of Türkiye, we discussed "child rights" with children as the main rights holders.

During the session participated by 20 children in-person and 100 children online, we first discussed the concept of advocacy. Our project experts held discussions with the children on what advocacy is, its effects, and how it should be done.

The Best Way to Learn is Through Experience!

In order for this session to leave an impression on the participating children, our experts preferred to be practitioners rather than just lecturers. During the event, various games were incorporated for enabling children to better understand the concept of advocacy.

In the session also attended by Dr. Musa Şahin, Director General of Child Services, our project experts gamified the issue of peer bullying after it was mentioned by the General Director and carried out a quick and effective activity with the children.

What Were The Rules of This Game?

Participating children were given papers. Then they were asked to crumple these papers. Afterwards, the children were asked to smooth out the paper again, but despite all the effort, it was not possible to make the paper go back to its original state.

At the end of this demonstration, it was explained to the children that these papers actually represented bullied children. Once hurt and bullied, children were unlikely to be as sound as before. Apologizing would not completely heal those wounds.

Does Every Child Have Equal Access to Rights?

Another game played during the meeting sought an answer to the question "Does every child have equal access to rights?" First, our experts rearranged the chairs in the room into 3 rows and seated each child in a certain chair. Then they placed a trash can half a meter away from the front row and asked the children to throw the paper balls they had into the can. While the children seated in the front rows were able to throw their balls into the trashcan, the children in the back rows had a hard time aiming at the trash can. Through this game, it was displayed that all children have equal rights (each child was given an equal number of paper balls), but they do not have equal access to these rights. At the same time, by assigning specific chairs to children at the beginning the experts gave the message that this unequal access was also imposed on children.

As Özne Çocuk, we will continue to gather with children to talk about advocacy and learn together.

We Started Our Work on Improving Child Care Services!

As Özne Çocuk, we aim to improve the standards and the accessibility of child care services in line with the UN Convention on the Rights of Persons with Disabilities, UN Guidelines for the Alternative Care of Children, and the EU Guidelines on the Promotion and Protection of the Rights of the Child. To this end, we carried out field visits in İzmir, İstanbul and Çankırı. In parallel with these field visits, we completed 11 focus group discussions with the personnel of the Ministry of Family and Social Services.

We also had the chance to observe child welfare policies and practices in Finland during a study visit held between December 11-16.

In line with the experiences gathered, our project team completed and submitted to the beneficiary institutions the following reports on the standards and practices applied in the EU countries: "Desk Study Report", "Comparative Analysis Report on Accessibility and Quality of Child Protection and Care Services", "Training Needs Assessment Methodology Report", "Good Practices Report" and "Quantitative Data Collection Process and Data Analysis".

What Did We Do in 2022 as the Özne Çocuk Project?

As Özne Çocuk Project, we kicked off our work in December 2021. Within the scope of our project, over the course of 3 years, we will carry out activities to support the Ministry of Family and Social Services and the Ministry of Labour and Social Security in the implementation of holistic and rights-based social policies for the best interests of children in Türkiye through a child-centered, rights-based and inclusive approach.

We have compiled the activities we carried out throughout 2022 for you below.

We Kicked off Quickly Our Preparatory Work!

We held our first meeting on 14 December 2022 with the participation of representatives of the beneficiary institutions, key experts of the project, and the technical assistance team. In this meeting, we exchanged ideas on the work we will carry out for 36 months, our expectations for the project, and what we can achieve with our project.

Our project is comprised of four main components and 31 activities in total.

Birinci bileşenin amacı, The first component aims to increase communication, coordination, advocacy, and cooperation among stakeholder organizations of child welfare and protection services in Türkiye.

İkinci bileşenin amacı, The second component aims to improve the standards, professional quality, and service models of the child protection and care system in Türkiye.

Üçüncü bileşenin amacı, The third component aims to develop effective tools for preventing and combatting child labour.

Dördüncü bileşenin amacı, The fourth component aims to strengthen protective, preventive and rehabilitative mechanisms for children under vulnerable conditions.

Özne Çocuk on Social Media!

Part of our preparatory work included creating our project identity and establishing digital visibility. After extensive consultations, we agreed on the short name of our project and,  thus, the short name "Özne Çocuk" [Subject/Agent Child] was created. Children as the agents of today, the future, and the agents of the family system!

We Prepared Our Six-monthly Reports!

In the first and second 6-month project interim reports prepared by our project key experts, we had the chance to share our work with the beneficiaries and the contracting authority under a single document.

We were in the Field for Focus Group Discussions in April!

Throughout the month of April, we conducted focus group discussions with the personnel of the Ministry of Family and Social Services and the Ministry of Labour and Social Security. These discussions helped us to analyse the needs of the child protection system. Moreover, for the quantitative component of our study, we collected data from 1754 personnel working in the provincial organization of the Ministry of Family and Social Services and 260 personnel working in the provincial organization of the Ministry of Labour and Social Security. This data guided our project team in the preparation of both the "Current Situation Analysis" and the "Communication, Coordination and Information Sharing Strategy Document" reports.

Özne Çocuk Meets With Civil Society!

In May and June, we met with civil society organizations working on child rights in Ankara and İstanbul. In our interviews, we had the chance to learn about the needs of civil society regarding advocacy and the challenges faced in public cooperation. We also exchanged ideas on how to solve the problems.

In light of the information obtained in these interviews and the work of our project experts, we have prepared a document titled "Public Advocacy for Children's Rights: A Step-by-Step Guide for Preparing an Action Plan". We aim for this guide to lead civil society organizations in their advocacy work.

We started our work on meeting with civil society organizations in the "Step by Step Advocacy" workshops that we will organize in 2023 and have the opportunity to work together.

12 July Çanakkale Children’s Gathering

Our project also aims to raise awareness about the negative effects of child labour in Türkiye. Therefore, we held our first event in Çanakkale on June 12, the International World Day Against Child Labour. In our children’s gathering carried out with the participation of more than 1300 children, we ensured that they had a pleasant day with outdoor activities, child-friendly games and activities.

We Started Working on TV Spots!

Within the scope of our project's awareness-raising activities, we plan to prepare TV spots informing the public about early marriage and child labour. In the last three months of 2022, we started working on their scenarios.

Improving Child Care Services is One of Our Goals!

We Completed our Work on Training Needs Assessment!

We completed a three-dimensional training needs assessment that examined the professional competencies in the field of child protection of the professional staff of the General Directorate of Child Services of the Ministry of Family and Social Services and the General Directorate on the Status of Women, as well as the professional staff working in the Units for Combatting Child Labour under the Ministry of Labour and Social Security.

Our project also aims to build the capacity of the Ministry of Labour and Social Security to improve intra- and inter-agency coordination, management and planning of actions to prevent child labour, including the protection of refugees and children under vulnerable conditions from abusive and exploitative working conditions.

In line with this goal, our project experts have started their work on training needs assessment. We will continue our work throughout 2023.

Our Work Will Continue in 2023!

This year, just as in 2022, we will continue our efforts to support our beneficiary institutions in implementing holistic and rights-based policies for the best interests of children in Türkiye.

Özne Çocuk Projesi Olarak Finlandiya Saha Ziyaretimizi Tamamladık!

Özne Çocuk olarak Finlandiya saha ziyaretimizi 12-17 Aralık 2022 tarihleri arasında tamamladık. T.C Aile ve Sosyal Hizmetler Bakanlığında görevli personelin ve projede görev alan uzmanların katılımıyla gerçekleştirilen ziyarette ulusal çocuk stratejisi, Finlandiya’da çocuk koruma sistemi ve koruyucu aile, suça sürüklenmiş gençlere yönelik çalışma modelleri, çocuk refahı gibi farklı konularda bilgiler edindik.

Ziyaretimizin İlk Gününde Finlandiya Sağlık ve Refah Enstitüsündeydik!

Saha ziyaretinin ilk gününde Finlandiya Sağlık ve Refah Enstitüsündeydik. Enstitü Geliştirme Müdürü Minna Sinkkonen’in açılış konuşmasıyla başlayan toplantıda aşağıda yer alan başlıklarda alanında uzman isimlerin konuşmalarını ve bilgi paylaşımlarını dinleme şansı yakaladık:

-Ulusal çocuk stratejisi

– Çocuk koruma alanında sistemik yaklaşım

-Çocuk refahı mevzuatı reformu

-Finlandiya’da çocuk koruma sistemi

-Finlandiya’da koruyucu aile

-Suça sürüklenen gençlere yönelik çalışma modelleri

Enstütü Geliştirme Müdürü yaptığı “Çocuk Koruma Alanında Sistemik Yaklaşım” sunumunda Finlandiya’nın bu alanda 2016-2022 arasında geçirdiği reform sürecinden bahsetti. Bu yeni yaklaşımın çocuk odaklı ve çocuk refahı için tüm paydaşları bir arada çalışmaya yönlendiren yapısının önümüzdeki aylarda Özne Çocuk olarak gerçekleştireceğimiz çalışmalara referans olmasını planlıyoruz.

Ziyaretimizin 2. Gününde Sivil Toplumla Bir Araya Geldik!

Ziyaretimizin ikinci gününde ise ilk olarak Finlandiya’da gençlik alanında çalışan bir sivil toplum örgütü olan Walkers/Children of the Station’ı ziyaret ettik. Dernek temsilcilerinden yaptıkları çalışmaları ve çocuk koruma alanındaki destekleyici çalışmaları dinleme şansı edindik. Ardından Helsinki’de yer alan Hyvönen Çocuk Evi’ni ziyaret ederek, kurum Direktörü Roope Tommila’dan çocuk evlerindeki işleyişi dinledik. Son olarak çocuk koruma alanında çalışan Mannerheim League of Child Welfare (Çocuk Refahı için Mannerheim Birliği) yetkilileriyle bir araya geldik.

Ziyaretimizin 3. Gününde Çocuk Köyü Uygulamasını Dinledik!

Ziyaretimizin 3. gününde Finlandiya Sağlık ve Refah Enstitüsü uzmanlarıyla yeniden bir araya geldik. İçişleri Bakanlığından Kıdemli Uzman Emilia Hämäläinen bizlere çocuk suçlarında erken müdahale modeli olan Anchor (Çapa) modelini tanıttı. Ardından Enstitü Baş Uzmanı Taina Laajasalo, Barnhaus modeli hakkında bizleri bilgilendirdi. Barnhaus Ağı’na dahil olabileceğimizi öğrenmek bizleri sevindirdi. Öğleden sonra gerçekleştirdiğimiz toplantılarda Esspo SOS Çocuk Köyü Kıdemli Uzmanı Elina Stenvall’dan çocuk köyünde verilen hizmetleri ve köyün işleyişini dinledik. Türkiye’de bu hizmeti nasıl geliştirebileceğimize dair tartışmalar yürüttük.

Ziyaretimizin 4. Gününde Grup Evlerindeydik!

Ziyaretimizin 4. gününde Esspo şehrinde yer alan refakatsiz çocuklar için kabul merkezi ve grup evlerini ziyaret ettik. Kurum Koordinatörü Marko Uuttu ve Sosyal Çalışmacı Annika Pirinen tarafından gerçekleştirilen sunumlarda kabul merkezi çalışmalarını ve iyi örnekleri dinleme şansı edindik.

Beş gün süren ziyarette çocuk refahı ve koruma sistemine ilişkin Finlandiya mevzuatını ve mesleki standartlarını anlamak, hizmet öncesi ve hizmet içi eğitimler hakkında bilgi edinmek ve ülkede çocuk koruma alanında gerçekleştirilen iyi örneklere dair uygulama süreçlerini öğrenmek için pek çok toplantı ve ziyaret gerçekleştirdik. Ayrıca sağlık, eğitim, sosyal refah, adalet vb. dâhil olmak üzere farklı paydaşların ve sektörlerin rolü ve özel gereksinimleri olan ve hassas koşullar altındaki çocuklara yönelik özel programlar ve ihtiyaçları hakkında fikir alışverişinde bulunma şansı da edindik.

Önümüzdeki süreçte, edindiğimiz bilgileri ve gözlemlediğimiz iyi uygulamaları nasıl hayata geçirebileceğimize dair çalışmalar gerçekleştirmeye devam edeceğiz.
